TERMS AND CONDITIONS (TERMS OF USE)

1. INTRODUCTION

This Terms and Conditions (“Terms”) constitutes a legally binding agreement between GVISION AND CAREERS (OPC) PRIVATE LIMITED (operating under the brand name “Global Vision and Careers”), a company duly incorporated under the laws of India, having its registered office at [Registered Address] (hereinafter referred to as the “Company”, “We”, “Us”, or “Our”), and any person accessing or using the website https://globalvisionandcareers.com/ (hereinafter referred to as the “User”, “You”, or “Your”).

By accessing or using the aforesaid website, its sub-domains, content, or any services offered thereon (collectively referred to as the “Platform”), You acknowledge that You have read, understood, and agreed to be bound by these Terms. If You do not agree, You are advised not to access or use the Platform.

The Company reserves the right to modify or amend these Terms at any time without prior notice. The revised Terms shall take effect upon publication on the Platform. Continued use constitutes acceptance of such revised Terms.

2. DEFINITIONS

Unless the context otherwise requires, the following expressions shall bear the meanings assigned below:

(a) “Services” means the educational, career, counselling, visa and immigration facilitation, job assistance, training, documentation, and allied consultancy services offered by the Company through the Platform.

(b) “Content” means all text, graphics, audio-visual material, software, logos, designs, templates, documents, and information available on or through the Platform, whether owned by the Company or licensed thereto.

(c) “Third-Party Services” means any website, institution, employer, university, payment gateway, or service provider not owned or controlled by the Company but linked to or integrated with the Platform.

(d) “User” means any individual or legal entity that accesses or uses the Platform or avails any Services, whether registered or unregistered.

3. SCOPE OF SERVICES

The Company provides professional consultancy and facilitation Services, including:

 (a) counselling for educational admissions and university applications;

 (b) career guidance, job and placement assistance; and

 (c) visa, immigration, and documentation support.

All such Services are advisory and facilitative in nature. The Company does not guarantee admission to any institution, employment with any entity, or visa approval by any government authority. Final decisions rest exclusively with the relevant institutions, employers, or embassies.

4. USER OBLIGATIONS

(a) The User shall access and use the Platform solely for lawful purposes and in accordance with applicable laws, including the Information Technology Act, 2000, and these Terms.

 (b) The User shall not post or transmit unlawful, defamatory, obscene, infringing, or harmful material; attempt to gain unauthorised access to the Platform; or use automated tools or scripts to extract data.

 (c) The User shall ensure that all information furnished is true, complete, and accurate.

 (d) The User shall indemnify and keep indemnified the Company, its officers, employees, and agents from all losses, claims, and liabilities arising out of breach of these Terms or misuse of the Platform.

5. FEES AND PAYMENTS

(a) Certain Services may be chargeable. All applicable fees, charges, and taxes shall be clearly communicated to the User prior to payment.

 (b) Payments shall be made only through authorised and secure payment channels in accordance with Our Payment and Pricing Policy.

 (c) The Company shall not be liable for delays or errors arising from third-party payment gateways or banking systems.

 (d) Refunds, where applicable, shall be governed by the Company’s Refund and Cancellation Policy.

6. INTELLECTUAL PROPERTY RIGHTS

(a) All intellectual property in the Platform and its Content, including copyrights, trademarks, trade names, designs, and know-how, vests exclusively in the Company.

 (b) The User is granted a limited, non-exclusive, non-transferable licence to access and use the Platform solely for personal and non-commercial purposes.

 (c) Any unauthorised use, copying, reproduction, or distribution of the Content is strictly prohibited and may invite civil and criminal liability under the Copyright Act, 1957 and Trade Marks Act, 1999.

 (d) All matters concerning intellectual property are further governed by the Company’s Intellectual Property Rights (IPR) Policy, which forms part of these Terms.

7. THIRD-PARTY LINKS AND SERVICES

The Platform may contain links to Third-Party Services for the convenience of Users. The Company neither controls nor endorses such third-party websites or services and shall not be liable for their availability, accuracy, legality, or content. Access to such Third-Party Services shall be entirely at the User’s own risk.

8. DISCLAIMER

(a) The Platform, its Content, and all Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied.

 (b) The Company disclaims all responsibility for errors, omissions, interruptions, or delays, and for any losses arising from reliance on the information containedherein.

 (c) The Company does not represent or warrant that the Platform shall be uninterrupted, secure, or free of viruses or defects.

 (d) Nothing on the Platform shall be construed as professional or legal advice unless expressly stated in writing.

9. LIMITATION OF LIABILITY

To the maximum extent permitted by law, the Company shall not be liable for:

 (a) indirect, incidental, special, consequential, or punitive damages;

 (b) loss of profits, data, goodwill, or business opportunities; or

 (c) any act, omission, or decision of third-party institutions, employers, or authorities.

The Company’s total liability, whether in contract or tort, shall not exceed the total amount paid by the User for the specific Service giving rise to such claim.

10. TERMINATION

The Company reserves the right to suspend or terminate a User’s access to the Platform at any time, with or without notice, in the event of breach of these Terms or for security, technical, or legal reasons. Upon termination, all rights granted to the User shall immediately cease.

11. GOVERNING LAW AND JURISDICTION

These Terms shall be governed by and construed in accordance with the laws of India. The courts at Hyderabad, Telangana, shall have exclusive jurisdiction over all disputes arising out of or in connection with these Terms.

12. GRIEVANCE REDRESSAL

In compliance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, the Company has appointed a Grievance Officer:

All complaints or grievances shall be acknowledged within 48 hours and resolved within 15–30 working days.

13. GENERAL PROVISIONS

(a) Severability: If any provision of these Terms is held invalid, the remainder shall continue in full force.

 (b) Waiver: No waiver shall be valid unless made in writing and signed by an authorised representative.

 (c) Assignment: The Company may assign or transfer its rights and obligations under these Terms without restriction.

 (d) Entire Agreement: These Terms, read with the Privacy Policy, IPR Policy, and other linked policies, constitute the entire agreement between the Parties.

 (e) Notices: All notices shall be sent via email or registered post to the addresses provided on the Platform.
